TERMS OF MEMBERSHIP. . . 

Definitions:

A "report" will be considered to be receipt by i-Watch of accurate and complete details required in the secure, online "Infringement Incident Report" form provided on the InfringementWatch website, completed by a bona fide Member having clear ownership of the work alleged to be exhibited or posted in violation of that Member's copyright.

An "infringement incident" will be constituted by a Member's report of the unauthorized exhibition or posting of any one to one hundred works at a single web domain or to a single newsgroup either in one individual report or in a series of consecutive reports on one calendar day through the "i-Watch" secure, online Infringement Report System. Later reports of same or similar infringements by the same or different infringer(s) will be considered additional and separate infringement incidents.

A "bona fide Member" is one whose fees for his membership plan of record are paid in full as of the date of his infringement incident report.


An "Individual Member" is entitled to staff action under his own name only as the owner of a registered copyright or the creator of a work entitled to common law copyright protection..

An "Exhibitor Member" may obtain staff action for incident reports filed on behalf of up to 25 different individual names during a paid membership term. Each such individual copyright holder must personally file any such incident report(s) - copying the Exhibitor Member, who - in order to initiate staff action on that report - must then ratify that report by forwarding his copy to i-Watch.

Procedures:

Upon notification by a bona fide Member of an infringement incident, i-Watch staff, under the supervision of Counsel, will begin a series of actions, escallating as necessary, to the primary end of removing the Member's work from its unauthorized exhibition. i-Watch staff will then assist Counsel in gathering appropriate evidence and proofs as well as investigating the circumstances of the infringement in order that Counsel may advise our Member of appropriate further action, if any.

Counsel will commence legal action only following the specific direction of the Member infringed, and only if, in Counsel's professional opinion, such action is appropriate, well grounded in both law and evidence, and reasonable in terms of risk and potential recovery.

Membership Fees:

Members who choose quarterly payment of their membership fees shall be entitled to i-Watch staff action on up to two (2) infringement incidents (up to 6 for Exhibitor Members) per prepaid ninety day term as a benefit of membership, and i-Watch staff action on additional reported incidents at rates set from time-to-time, dated and posted publicly on the i-Watch website. 

Members who choose annual payment of their membership fees shall be entitled to i-Watch staff action on up to twelve (12) infringement incidents (up to 36 for Exhibitor Members) during the prepaid 365 day term of their membership, and i-Watch staff action on additional reported incidents at rates set from time-to-time, dated and posted publicly on the i-Watch website.

Staff action on additional reported infringement incidents, beyond those included in a Member's prepaid plan during any membership period, will commence following transfer by the Member of appropriate funds as requested by i-Watch staff.

Members may not accrue "incident credits" past the term of any paid membership period.

Voting, Officers & Bylaws

Only the founding Charter Members of Infringement Watch.org (or members elected from time-to-time by a majority of Charter Members) may vote for officers or revisions to the bylaws of the Organization.

Other Terms & Conditions:

Should Counsel advise and a Member agree to seek compensation or damages from a particular infringer, Counsel will provide to Member a "Retainer Agreement" setting forth Counsel's contingency fees and estimated expenses to be deducted from any settlement or recovery.

Neither InfringementWatch nor its Counsel make or imply any guarantees of specific results in consequence of their efforts in behalf of i-Watch Members, though provisions of law and the general practices of most web service providers suggest that we should expect success in the vast majority of actions taken for the expressed and primary purpose of removing the work of i-Watch Members from unauthorized appearances on the Internet.
